ASJ Law Office A Client Centered Law Firm Where Families Matter.
Details:
Client added wife’s name to his deed after marriage while ill, believing it would protect the home for the future. No prenuptial or postnuptial agreement was in place. During the divorce, the property was presumed marital.
Strategy:
We argued that the majority of the home’s equity remained separate property because it was acquired and substantially paid for before the marriage. We also argued that marital debt should be divided using the same equitable distribution principles.
Outcome:
Client preserved the bulk of his retirement account. Client kept the marital home. Marital debts were divided fairly based on contribution and equity, limiting his exposure to additional liabilities.
Details:
After a contentious divorce, the mother refused to allow the child to travel internationally to visit the father's side of the family.
Strategy:
Filed a post-judgment application requesting permission for the child to travel abroad, demonstrating that fostering a relationship with extended family was in the child’s best interest.
Outcome:
Court granted the father permission for international travel with the child.
The child maintained a relationship with the father’s family overseas — protecting the child's cultural and emotional ties.
Details:
Father’s time with his child was unjustly reduced to supervised visits limited to the backyard of the mother’s home for nearly two years.
Strategy:
Filed a post-judgment application to restore full parenting rights, arguing that outdoor-only visits were harmful and not conducive to a healthy parent-child relationship.
Outcome:
Court allowed unsupervised parenting time outside of the mother’s home. Child was permitted to go on vacations with the father. Father was awarded joint legal custody — reinstating his right to participate in major decisions about the child’s life.
Details:
Client contacted us less than 60 days before his wedding needing a prenuptial agreement.
Strategy:
We moved efficiently, drafting a comprehensive prenup that protected his current assets, future earnings, and expected inheritances. We also coordinated with the fiancé’s attorney to keep the process smooth and non-confrontational.
Outcome:
Full asset protection secured before the wedding. Agreement signed well before the wedding date, with no drama or delay. The fiancé signed willingly without feeling pressured, reducing any future challenge to the agreement.
Details:
Father moved the child to Georgia without the mother’s consent or court approval.
Strategy:
Filed an emergency application demanding the immediate return of the child to New York.
Outcome:
Court ordered the father to bring the child back to New York immediately at his own expense. All future parenting time ordered to occur in New York unless otherwise agreed. The case ultimately settled: the father obtained residential custody on consent of our client because she thought it was in fact best for the child, but the mother’s child support obligation was significantly reduced to reflect the new circumstances.
Details:
Father was denied access to his child for eight months because the mother was upset about his new relationship.
Strategy:
Filed an emergency motion demanding immediate access for the father.
Outcome:
Court ordered immediate parenting time reinstatement. Father and child were reunited after months of wrongful alienation, restoring the parental bond.
Details:
Father’s work schedule changed, and he needed more parenting time. Under the law, a change in work schedule alone doesn't require a modification.
Strategy:
Negotiated an out-of-court agreement to expand the father’s parenting time without prolonged litigation.
Outcome:
Father received increased and consistent access to his child. Case resolved without costly court battles or delays.
Details:
Husband evaded service for months in an attempt to delay the divorce.
Strategy:
Pursued alternative service options and filed for default judgment.
Outcome:
Client was granted a divorce without the husband’s cooperation. Court awarded spousal support to our client based on the husband’s default and financial disclosures.
